Long Island Child Support Lawyers

Nothing is more important to us than our children. For this reason, the law of child support is carefully laid out in the state statutes. These laws are also updated to reflect changing conditions and ideas.

It is now most common for both parents to work and have some income. Both parents' income is taken into consideration in setting an appropriate amount of monthly support for the children.

Guidelines

The statutes contain a formula starting with the gross (not net) income of the parents, deducting only FICA and Medicare taxes. A set percentage is then applied to this amount, depending on the number of children. The percentage is higher than most people expect.

For those with a very high income, the percentage applies only to the first $130,000. This is a recent change from $80,000. In other words, if you or your spouse had an income of $250,000 per annum, the percentage to arrive at the final amount would only be applied to the first $130,000. Judges have discretion with respect to income over $130,000.

The amount for which each parent is responsible is prorated: the person with the higher income will pay a higher percentage of the total.
