Like child support, spousal maintenance is an evolving area that many lawyers (and even judges) don't understand. Unlike child support, there is no mathematical formula for spousal support. This makes it difficult to predict what a court will award. The statutes do set out factors for determining the amount. Basically, spousal maintenance/spousal support is intended to rehabilitate a spouse who has weak job skills or cannot fully support him or herself immediately. The concept of alimony was that (usually) the wife was unlikely ever to possess the education and job skills to support herself. This is no longer the case. Currently lifetime maintenance is unlikely unless one party is disabled. In a complicated area such as this, you need an experienced matrimonial attorney who is current on the law and what the courts are doing. A recent development in the law is greater ease in obtaining temporary maintenance. A spouse who cannot currently support him or herself might be afraid to leave a bad marriage. Temporary maintenance is intended to assist during the divorce process. We negotiate settlements out of court whenever we can, but when circumstances dictate litigation, we aggressively represent our clients’ interests in court.
